The Will of Thomas Sudborough, Cordwainer
Properties facing The Cross mentioned in wills
This 1923 aerial photograph shows a block of properties with the long
malthouse prominent on the left. This and the surrounding properties
are all mentioned in a series of indentures and wills now owned by
Burton Latimer Heritage Society.

Office copy of the will of Thomas Sudborough dated 9th Novr. 1787

 Extracted from the Public Registry of the Archdeacon of Northampton

In the name of God Amen I Thomas Sudborough of Burton Lattimer in the County of Northampton Cordwainer do make and Publish this my last Will and Testament in manner following (that is to say) I give and bequeath unto my nephew Joseph Sudborough his executors or administrators the sum of one hundred and fifty pounds of lawful Money of Great Britain Upon Trust to put and place out and from time to time to keep and continue the same out at Interest as occation  shall be or require upon one or more good and sufficient real Security or Securities or otherwise to lay out the same in the purchase of stocks in any one or more of the Publick Funds or Government Securities as he or they shall think proper and expedient. And to pay and apply the Interest, Dividends or annual produce of the said Sum of one hundred and fifty Pounds unto my Son Thomas or otherwise permit him to receive the same for the Term of his natural Life and from and after the decease of my said Son Thomas  Then upon Trust to get in and receive the said Sum of one hundred and fifty pounds and to pay, apply and divide the same or otherwise to assign or Transfer the Securities or Stocks whereon the same shall be laid out or invested unto, between and amongst all and every the Child and Children of my said Son Thomas then living and the Issue of such of them as shall then be dead equally Share and Share alike such Issue to take a parents Share only to be paid or transferred to them respectively at the age of twenty one or Day of Marriage which shall first happen and the Interest Dividends or Produce thereof to be in the meantime applied towards their Education and Maintenance respectively And in Case such Children of my said Son Thomas shall depart this Life before their Parts or Share of and in the said Sum of One hundred and fifty pounds shall become due and Payable without having Issue Then I will and direct that the whole of the said Trust Monies shall go and be paid to the Executors or administrators of my said Son Thomas Provided always and my will is that it shall and may be lawful for my said Trustee his executors or administrators to pay or apply any part of or parts of the said last mentioned principal Sum of one hundred and fifty Pounds not exceeding in the whole the Sum of Thirty pounds unto and for the support and maintenance of my said Son Thomas or of Elizabeth his now wife in Case he or she shall be in actual want when and as my said Trustee his executors or administrators shall think Proper or expedient so to do. Also I give and devise unto my said son Thomas All that my Messuage or Tenement with the appurtenances in Burton Lattimer aforesaid now in his own occupation To hold to my said son Thomas and his assigns for and during the term of his natural life and from and after his decease in Case  my Grandson Joseph Sudborough Son of the said Thomas be then living I give and devise the same unto my Grandson his heirs and assigns for ever But in Case my Grandson   shall happen to depart this Life in the Lifetime of his said Father Then I give and devise the said Messuage or Tenement with the appurtenances from and immediately after the decease of my said Son Thomas unto and to the use of my own Right heirs for ever  Also I give and devise unto my Son Joseph Sudborough his heirs and assigns All that my Dwelling house with Close of Pasture thereunto adjoining and belonging And all that my Messuage or Tenement of William Smith And all that my Butchers Shop and Close of Pasture in the Tenure of Robert Capps adjoining to the said last mentioned Messuage And all other my real Estate whatsoever in Burton Lattimer aforesaid and elsewhere to hold the same unto my said Son Joseph his heirs and assigns for ever Also I give and bequeath unto my said Son Thomas his executors and administrators all my Tools and Stock in trade as a Shoemaker  and also all my Books Debts, Sum, and Sums of Money due and owing to me in the Way of my Trade as a Shoemaker to and for his and their own Use and Benefit . And as to for and concerning all the rest and residue of my Estate and Effects Whatsoever and Wheresoever after payment of my Just Debts and Funeral  Expenses I give and bequeath the same unto my said Son Joseph His Executors administrators or assigns to and for his and their own Use and Benefit And I do hereby nominate and appoint my said Son Joseph Sole Executor of this my last Will and Testament And I do hereby order and direct that my said Nephew Joseph Sudborough his executors or administrators shall not be answerable or accountable for any loss that may happen to the said Trust Money or any Part thereof without his or their wilful Neglect or Default And shall have power  from time to time to call in and again to place out the same upon any new or other real Security or Securities as he or they shall think proper And shall and may from Time to Time Reimburse and retain to him and themselves out of the said trust Money all such just and reasonable Costs and Charges as he or they shall or may sustain or be put unto in the Execution of the Trusts hereby in him and them reposed and Lastly hereby revoking all former Wills I do declare tis Present Writing only to be and contain my last Will and Testament In Witness whereof I the said Thomas Sudborough the testator have to this my last Will and testament set my hand and Seal this Ninth day of November In the Year of our Lord one Thousand seven hundred and eighty seven

Thomas Sudborough Signed Sealed, published and declared by the said Thomas Sudborough the Testator as and for his last Will and Testament in our presence and attested and Subscribed in his presence and in the Presence of each other by us

On the 9th Day of September in the Year of our Lord 1791 the Original will was proved in Common Form of Law before the Revd Joseph Knight Clerk Surrogate lawfully appointed on the Oath of Joseph Sudborough the Sole Executor therein named to whom &c.
