WILL OF RICHARD HARPER otherwise HARPUR 1806 proved 1813
I Richard Harper of Burton Lattimer in the County of Northampton Esq. being of sound mind memory and understanding do make and publish this my last Will and Testament in manner following that is to say. First I desire that all my just Debts Funerial and Testamentary Charges and Expences may be fully paid and satisfied. I give devise and bequeath unto my Friends Edmund Tompkins of Snowford in the County of Warwick Gentleman and the Reverend Bernard Gilpin Ebdell of Chilvers Coton in the said County of Warwick Clerk all that my moiety or half part of all that Messuage or Tenement Farm Land Hereditaments and Premises with the appurtenances situate and being at Wolvey in the said County of Warwick and all other my Real Estate whatsoever to hold the same with the appurtenances unto the said Edmund Tompkins and Bernard Gilpin Ebdell their heirs and assigns for ever upon and for the uses trusts and interests and purposes hereinafter mentioned that is to say, upon trust that they the said Edmund Tompkins and Bernard Gilpin Ebdell or the Survivor of them his Assign and Assigns do and shall at such time or times as they or he shall or may think proper absolutely sell and dispose of my said moiety of the said Messuage or Tenement Farm Lands and Hereditaments and Premises and all other my Real Estate either together or in lots by public auction or private contract as they or he shall think best and on such sale or sales do and shall convey assure and make over the same to the purchase or purchases thereof his her or their Heirs or Assigns for ever or as he or they may direct and do and shall review and take the consideration arising from such sale or sales and thereout pay and discharge all such Costs and Expences as shall be occasioned thereby and then do and shall lay out a sufficient part of the moiety to arise by such sale or sales in the purchase of Freehold Messuage Lands or Hereditaments of an Estate of Inheritance in fee simple in possession in that part of Great Britain called England of the clear yearly value of one hundred pounds free from all incumbrances whatsoever and have the same settled conveyed and assured to for and upon such and the same uses trusts intents and purposes and under and subject to such and the same powerws provisoes and limitations or as near thereto as the death of parties will admit as are mentioned or referred to of and concerning an Estate of the like yearly value by me Covenanted by the settlement made previous to and in contemplation of my marriage with my present wife Susannah Harper to be purchased and settled but which purchase I have not yet made and I Will and order that the Estate hereby directed to be purchased by my said Trustees and Conveyed as aforesaid shall be accepted and taken in Discharge of my Covenant in my said Marriage Settlement for purchasing an Estate of like yearly value and I also direct that from the time of the sale of my said Real Estate by my said Trustees until such purchase shall be made by them as aforesaid they shall stand and be possessed of the money sufficient for that purpose upon Trust to put and place the same out at Interest in their or his names or name upon Government Real or other good Security and pay and apply the same and the Dividends Interest and Proceeds thereof in the same way and to such person or persons as would be entitled to the Rents and Profits of the said Freehold Estate if the same was purchased and conveyed as aforesaid and I also direct that they my said Trustees shall by and out of the Rents and Profits of the Real Estates of which I am now seized until they shall have sold the same under the authority of this my Will pay unto my said wife Susannah Harper the annuity or yearly Sum of One hundred pounds to and for her sole and separate use and benefit half yearly the first payment thereof to begin and be made at the end of Six Months after my decease and I further Will and direct that the same shall be taken and accepted by her in satisfaction of the provision intended her by my said Covenant in the said Marriage Settlement until my said Estates shall be sold as aforesaid I give and bequeath unto the said Edmund Tompkins and Bernard Gilpin Ebdell all my Household Goods and other my Personal Estate whatsoever upon Trust that they my said Trustees or the Survivor of them his Executors or Administrators do and shall at such time or times as they or he shall think fit sell and dispose thereof (except my Household Goods and Furniture hereinafter mentioned) and put and place the money to arise thereby and also the remainder of the money to arise from the Sale of my said Real Estate and all other my monies whatsoever out at Interest in their or his Names or Name upon such Security or Securities as they or he shall approve and pay the dividends interest and proceeds thereof and also the remainder of the Rents and Profits of my said Real Estate after payment of the said annuity to my said wife until such Real Estate is sold as aforesaid or so much thereof as they my said Trustees shall think fit and necessary in the maintaining bringing up Cloathing Educating Apprenticing and putting out in the world of my several children already or hereafter to be born until they shall have attained their respective ages of Twenty one years and then upon Trust that they my said Trustees do and shall pay and divide the said Trust Monies unto and amongst all my Children share and share alike when and as they shall attain their respective ages of Twenty one years to whom I hereby give and bequeath the same respectively and I direct my said Trustees to permit and suffer my said wife Susannah Harper to have the use of and enjoy all my Household Goods Plate Linen and other Household Furniture and utensils for and during the term of her natural life and from and after her decease then upon Trust that they my said Trustees do and shall direct the same or sell and dispose thereof and pay and dispose of the money to arise thereby and all other my Personal Estate whatsoever unto and equally amongst all my Children share and share alike provided always and I Will and direct that if either or any of my Children shall die before he she or they shall attain his her or their age of Twenty one years leaving a child or children of his her or their Body or Bodies lawfully begotten then such children shall be entitled to and have the share of his her or their Father or Mother so dying of and in the said Trust Monies in equal proportions if more than one and if but one child thensuch one child shall have and be entitled to the whole share of his or her deceased parent provided also and in case any or either of my Children shall depart this life before his her or their share of the said Trust Monies shall become due to him her or them respectively without leaving lawful issue of his her or their Body or Bodies begotten then I will and direct that the share or part of him her or their so dying without issue as aforesaid shall go to and become the property of his her or their surviving Brothers and Sisters if more than one in equal shares and if but one of them shall survive then to such one as surviving to and for his or her own use and benefit and I also Will and endow that my said Trustees shall and may apply such part of my Childrens respective portions as they in their discretion may think proper in the .maintainenceEducation Cloathing bringing up and putting them out apprentice or for their advancement in the world and I do hereby expressly Will order and direct that the conveyance and assurance of my said Trustees or the survivor of them his Heirs or Assigns of my Real Estate hereinbefore directed to be sold or any part thereof and their or his receipt or receipts for the purchase money shall be a good and sufficient Conveyance Title and discharge to the purchase or purchases thereof without his her or their having to or being in any wise answerable for the misapplication or nonapplication of such purchase money or any part thereof and my mind and will is that either of them my said Trustees or the Survivor of them his Heirs Executors or Administrators shall be answerable or accountable for more of the said Trust Estate Monies or Effects than they shall respectively actually receive nor for any loss thereof or of any part thereof nor for the insufficiency of any assets taken for the same unless such loss or insufficiency happen without his or their wilful neglect or default and that each of them my said Trustees shall and may by and out of the said Trust Monies and Effects reimburse and pay themselves and himself all such Costs Charges and Expences as they or either of them shall or may sustain expend or be put unto in the executing and performing or endeavouring to execute and perform the Trusts hereby in them imposed and lastly I hereby Nominate Constitute and appoint the said Edmund Tompkins and Bernard Gilpin Ebdell Executors of this my last Will and Testament In Witness whereof I the said Richard Harper the Testator have to this my last Will and Testament in witness whereof I the said Richard Harper the Testator have to this my last Will and Testament written and contained on four sheets of paper to the first three sheets thereof set my hand and to the fourth and last my hand and seal the 29th day of April in the year of our Lord one thousand eight hundred and six - Richd. Harper - Signed Sealed Published and declared by the said Testator Richard Harper as and for his last Will and Testament in the presence of us who in his presence at his request and in the presence of each other have hereunto subscribed our names as witnesses - Chas. Gibbon - Henry Robinson - Thos. Burnaby junr.
On the 25th August 1813 Admon. with the Will annexed of the Goods of Richard Harper otherwise Harpur late of Burton Latimer near Kettering in the County of Northampton Esquire deceased was granted to Susannah Harper Widow the natural and lawful Mother next of kin and Curatrix or Guardian lawfully assigned to Augustine Joseph Harper, Laura Harper spinster, Edmund Harper and Mary Harper spinster Minors, the natural lawful and only Children and the Risiduary Legatees named in the said Will for their use and benefit and until one of them shall attain the age of Twenty one years having been first sworn duly to administer Edmund Tompkins and The Reverend Bernard Gilpin Ebdell Clerk the Executors and Universal Legatees In Trust named in the said Will having first respectively renounced as well the Probate and Execution thereof as the Letters of Admon. with the said Will annexed of the Goods of the said deceased.
