Will of Joseph Payne

November 2nd 1857


This is the last Will and Testament of me Joseph Payne of Burton Latimer in the County of Northampton Draper and Tailor which I make publish and declare in the manner following that is to say I give and bequeath all and singular my Household goods and Furniture stock in the trade moneys and securities for money debts and all other my personal Estate whatsoever which I shall be possessed of at the time of my decease. Unto my dear wife Martha Payne for her own absolute use and benefits charged nevertheless with the payment of all my just debts and my funeral and testamentary expenses. I give and devise All that my Cottage or Tenement with the Garden and **** appurtenances to the same belonging situate at Burton Latimer aforesaid which I purchased of ……….. Sudborough Widow and now in the occupation of Thomas Munns to my said dear wife Martha Payne to hold to her heirs and assigns for ever. And as to all other my Messuages Cottages Closes Lands Tenements Heriditaments and Real Estate whatsoever situate in Burton Latimer aforesaid or elsewhere I give and devise the same and every part thereof with their appurtenances unto my said wife Martha Payne and her assigns for and during the term of her natural life, she my said wife keeping and maintaining the same in good and tenantable repair and condition and from and after her decease I give and devise the said messages cottages closes and Lands Tenements hereditaments and real Estate and every part thereof with their appurtenances unto my two sons Joseph Payne and John Payne to hold to them my said sons their heirs and assigns for ever as Tenants in common and not as joint Tenants. And I appoint my said wife Martha Payne and son Joseph Executrix and Executor of this my will. And lastly hereby revoking all former and other wills by me at any time heretofore made. I declare this above to be and contain my last will and testament. In Witness whereof I the said Testator Joseph Payne have hereunto set my hand and seal the tenth day of February – one thousand eight hundred and thirty seven.
