Will of Robert Capps of Burton Lattimer, Yeoman. 15th November 1819.  Proved 26th July 1820.

This is the last Will and Testament of Robert Capps of Burton Lattimer in the County of Northampton Yeoman. First I give and devise to my Grand son John Capps the House in which he now dwells together with that adjoining and under the same Roof formerly a butcher’s shop the Barn and Garden and appurtenances thereunto belonging situate in the Parish of Burton Lattimer and which I Purchased of Edmund Eady, his Heirs and assigns for ever on Condition that he pay to Sary Capps [his daughter] now Sary Omen [Sarah Holman] residing at Isham in the said County of Northampton Five Pounds a year successively the first four years after my decease. I do hereby subject and charge the aforesaid Estate with the payment of five Pounds annually for the first four Years after my decease should Sary Omen dye before the expiration of four Years after my decease then my Will is that the afore said Money charged on the aforesaid Estate be equally divided among her surviving Children. I give and devise to my Grand Daughter Ann Mee all that my Tenement Garden and Houses and appurtenances thereunto belonging which I Purchased of Joseph Patrick and now in the occupation of My Son and Daughter Richard and Martha Garratt. To hold to her my said Grand Daughter Ann Mee her Heirs and assigns forever situate in the Parish of Burton Lattimer in County of Northampton. Also I devise to my Grand Daughter Ann Mee the best Bed together with all its Furniture now standing in the best Chamber. Also I give to Ann Mee a Beaurow all which she shall have a right unto and take  Possession of when she shall have attained the age of twenty years. My Will also is that the Money arising from the aforesaid Estate be applied towards the support and Maintenance of Ann Mee until she shall attain the age of twenty years – providing my said Grand-daughter Ann Mee should dye before she attain to the age of twenty years then my Will is that the aforesaid Estate becomes the right and Property of my Daughter Martha Capps now Martha Garratt her Heirs and assigns for ever but providing Ann Mee live to the age of twenty years she shall be authorised to leave the  aforesaid Estate to whom she will.

I give and devise to my Daughter Martha Capps now Garratt all that Tenement in which I now dwell situate in the Parish of Burton Lattimer and in the County of Northampton consisting of a dwelling House and a Close thereunto adjoining as  it now is together with a Garden Barn stables and all other appurtenances thereunto belonging to hold to my said Daughter her Heirs  and assigns forever – also I give to my Daughter Martha Garratt all that Field situate in the Parish of Burton Lattimer and in the County of Northampton consisting of two Acres and a half more or less to hold to her my said Daughter Martha her Heirs and assigns forever also I give unto my Daughter Martha all my Household Furniture of every description or of whatsoever it may consist at my death except the Bed and Beaurow I have given to my Grand Daughter Ann Mee afore said in this my last Will and Testament. And I give to my said Daughter Martha all my Chattels Goods Moneys Securitys for Money and Personal Estate whatsoever I shall be possessed of interested in or Intitled to at my Death except the Estate given to John Capps and that I have given by Will to my said Grand Daughter Ann Mee. And I do hereby constitute and appoint my said Daughter Martha full and sole Executrix of this my last Will and Testament by discharging all my legal Debts and giving my Body a decent burial. And I do hereby revoke all former Wills by me made and declare this to be my last Will and Testament. In Witness where of I now set my Hand and Seal this 15 Day of November in the Year of our Lord one thousand eight hundred and nineteen.

Signed sealed and declared by the said Robert Capps for his last Will and Testament in the presence of us who in his presence and at his request have subscribed our Names as Witnesses hereunto.

On the twenty sixth day of July 1820. Martha Garratt the Sole Executrix named in the above Will was then sworn well and faithfully to fulfil the same according to Law, & that the Goods, Chattels and Credits of the within named Robert Capps, deceased, who died on the twenty fourth day of January 1820, do not amount in value to the sum of three hundred pounds.       Before me        Charles Pryce M.L.    Surrogate
