The Will of Thomas Payne, Gentleman

Thomas Payne left ten pounds to the County Hospital, seen on the
right in George Row, Northampton, next to the County Gaol

In the name of God Amen. I Thomas Payne of Burton Lattimer in the County of Northampton Gentleman being thanks be to god of a sound mind memory and understanding do this third day of September one thousand seven hundred and eighty four make and appoint this my last Will and Testament in manner and form following (that is to say) ffirst I give and devise unto my Sister Mrs ffrances Partridge all my real Estates of what nature or kind soever in Burton Lattimer aforesaid and Isham in the County of Northampton or elswhere in the Kingdom of Great Britain to hold to her for and during the term of her natural life without Impeachment or Waste and from and after her decease I give and devise the same unto all and every the Daughter or Daughters that now are or shall hereafter be lawfully begotten on the body of my Niece Mrs ffrances Hanbury to be equally divided between or among them if more than one share and share alike as tenants in common and of the several and respective Heirs of the Body and Bodies of all and every such Daughter or Daughters lawfully issuing for ever and in default of such issue I give the same to my own Right Heirs for ever I give and bequeath unto my Brother Robert Payne the Sum of thirty pounds a year to be paid hym half yearly for and during the term of his natural life out of my Estates in Burton Lattimer and Isham aforesaid the first payment to be made within one half year after my decease and I hereby charge the said Estate with the payment of the same accordingly with Power to the said Robert Payne to distrain in case of non-payment. I give and bequeath unto the treasurer of the County Hospital at Northampton for the time being the Sum of Ten pounds for the use of that Hospital. I give and bequeath unto the the Parish Officers of Burton Lattimer aforesaid the Sum of ffive pounds to be distributed amongst the poor of that parish. I give and bequeath unto the Parish Officers of Isham aforesaid the Sum of ffive pounds to be distributed amongst the poor of that Parish the above Legacies to be paid one year after my decease. All the rest and residue of my Goods Chattels and Personal Estate of what nature and kind soever. I give and bequeath unto my said Sister ffrances Partridge to hold for and during the term of her natural life she paying thereout my due Debts, Legacies and ffuneral Expences and after her decease I give the same to and amongst all and every the Daughter or Daughters of my said niece ffrances Hanbury to be equally divided to and amongst them if more than one share and share alike. And I hereby appoint Mr Samuel Wallis of Barton Seagrave Lodge in the said County of Northampton ffarmer trustee for such Daughter or Daughters of my said Niece ffrances Hanbury lawfully begotten or to be begotten and it is my Will that the said Samuel Wallis from and immediately after the Death of my said Sister ffrances Partridge shall enter upon the said real and Personal Estate and receive the Rents and Profits thereof and convert the said Personalty into ready money and put the same out to Interest or otherwise to improve and increase the same for the only proper Use and Benefit of the Daughter or Daughters of my said Niece ffrances Hanbury until they shall be of full age and intitled to the Distribution by the Death of my said Niece or otherwise and in case of the Death of the said ffrances Hanbury and the said Daughter or Daughters if more than one shall have each attained their respective ages of twenty one years that then the said Samuel Wallis shall immediately account with the said Daughter or Daughters of my said Niece for all monies received and accumulated and Monies laid out and expended and shall pay the Overplus to such Daughter or Daughters if more than one share and share alike and also give up the Possesssion of the said Real Estate first deducting to himself the sum of ffifty Pounds for the execution of this trust and in case there shall be no ffemale Issue from the Body of the said ffrances Hanbury then I give and bequeath the said Personalty after the Death of the said ffrances Partridge unto my own Right Heirs for ever and Lastly I make and appoint my said Sister ffrances Partridge Sole executrix of this my Will hereby revoking all former and other Wills by me at any time heretofore made. In Witness whereof I the said Thomas Payne the testator have to this my last Will and testament Contained in this and the other Sheet (erased) hereunto annexed together with Wafers at the Top, set my hand only to the first sheet and to this last Sheet my hand and Seal the day and year first written above. Thos. Payne signed sealed published and declared by the said Thomas Payne the Testator as and for his last Will and Testament in the presence of us who in his presence and in the presence of each other have set our Names as Witnesses the Erazure being first made George Wakeman Wellingborow, Joseph Wood Burton Lattimer, John Newton Goodhall Wellingborow.
